Managing Partner Edward Huguenin and Partner Drew Wagner-Weir successfully litigated a motion for attorney fees, securing an award of $175,000 in attorney fees for the client. The client was sued for breach of contract and fraud. The breach of contract claims were dismissed following a successful demurrer, leaving only the fraud causes of action. After years of litigation, this office filed a motion for summary judgment on the fraud causes of action, which the court granted. Following the victory, this office sought attorney fees, relying on a prevailing party attorney fee clause in the underlying contract. The court ultimately interpreted the clause to cover a tort action where the underlying contract was asserted as a defense, and granted the motion for attorney fees.
