Kirk A. Agee

Kirk Agee is a dual-licensed trial attorney admitted in Texas and California with more than nine years of high-stakes litigation experience representing both plaintiffs and defendants. As a plaintiff’s lawyer, he has won millions for clients at trial and helped secure more than $20 million in settlements. His plaintiff-side work has included wrongful death and catastrophic injury matters, as well as property related injuries.

On the defense side, Mr. Agee has defeated numerous high-exposure claims across a wide spectrum of issues, including claims under Title VI, Title VII, Title IX, the ADA, Section 504 of the Rehabilitation Act, the FMLA, the ADEA, the IDEA, USERRA, the U.S. Copyright Act, Section 1983, the Texas Labor Code, the Texas Water Code, the United States and Texas Constitutions, and numerous federal and state common law causes of action. Mr. Agee is particularly known for precise, strategic motion practice that positions cases for early dismissal when the law and facts permit and, when resolution is not possible, favorably frames cases for trial.

Mr. Agee has regularly advised in-house counsel and executive officials of some of the largest employers and public entities in Texas with respect to any matter pertaining to or implicating client interests. He also maintains a strong appellate record, having prevailed in multiple Texas appellate courts and the United States Court of Appeals for the Fifth Circuit, and is known for pairing trial readiness with formidable appellate advocacy.

Mr. Agee graduated from the University of Texas School of Law and has been recognized by Thomson Reuters© Texas Super Lawyers as a Rising Star in 2026. Texas Super Lawyers is an exclusive list, recognizing the top 5% of attorneys in Texas, with 2.5% or fewer of attorneys being selected as Rising Stars. During law school, Mr. Agee clerked for the Honorable Judge John Ellisor in the 122nd District Court of Galveston County, Texas.
